These Terms & Conditions govern purchases made through the Bambolina online store available at bambolina.pl.
1. STORE INFORMATION
The online store operating at bambolina.pl, hereinafter referred to as the “Store”, is operated by:

These Terms & Conditions set out the rules governing the use of the Store, placement and fulfilment of orders, payments, delivery, withdrawal from distance contracts, returns and complaints.
The Store operates under Polish law and sells products to Customers in Poland and internationally.
2. DEFINITIONS
For the purposes of these Terms & Conditions:
Customer – a natural person, legal person or organisational entity placing an order through the Store.
Consumer – a natural person entering into a contract with the Store for purposes not directly related to their business or professional activity.
Where required by applicable Polish law, certain consumer rights also apply to a natural person conducting business activity who concludes a contract directly related to that activity where the contract does not have a professional character for that person.
Product – a physical product offered for sale through the Store.
In-stock Product – a Product that has already been produced and is available for preparation and dispatch.
Made-to-order Product – a Product from Bambolina’s standard collection that is produced after the Customer places an order, using standard variants, colours and sizes offered by the Store.
Pre-order Product – a Product offered for purchase before its planned production, completion or availability for dispatch.
Personalised Product / Custom Product – a non-prefabricated Product manufactured according to the Customer’s individual specifications or clearly personalised for that Customer.
3. GENERAL RULES

Orders may be placed through the Store twenty-four hours a day, subject to temporary technical interruptions.

The Customer must provide true, complete and accurate information necessary to process and deliver the order.
-
Registration of a customer account is not required unless otherwise indicated during checkout.
-
To use the Store, the Customer requires an internet-enabled device, a current web browser and an active e-mail address.
-
All Products offered by the Store are new unless clearly stated otherwise.
-
Product descriptions, photographs, composition, sizes, available variants and relevant product information are displayed on individual product pages.
-
Bambolina products are handmade or produced in small batches. Minor variations in knitting tension, texture, dimensions, shape, finish or placement of handmade elements may naturally occur between individual pieces.
-
Such minor differences resulting from the handmade production process do not constitute a lack of conformity with the contract where they do not materially affect the Product’s functionality, safety or characteristics agreed with the Customer.
-
Colours displayed on a screen may vary slightly depending on the Customer’s device, display settings, lighting conditions and other technical factors.
4. PRODUCT TYPES AND PREPARATION TIMES
In-stock Products
In-stock Products are normally prepared for dispatch within 2–5 working days after the order and payment have been successfully confirmed.
Made-to-order Products
Made-to-order Products are made after the Customer places an order.
Unless a different preparation period is stated on the Product page, preparation may take up to 30 working days.
A Made-to-order Product selected from Bambolina’s standard colours, sizes and variants is not automatically considered a personalised Product.
The fact that a standard Product is handmade or produced only after an order has been placed does not by itself exclude the Consumer’s statutory right of withdrawal.
Pre-order Products
A Pre-order allows the Customer to purchase a Product before its planned production, completion or availability for dispatch.
The expected production or dispatch period will be stated on the relevant Product page wherever reasonably possible.
Dates indicated for Pre-order Products are estimates and may change due to the handmade production process, supply delays or circumstances beyond the Store’s reasonable control.
If a significant delay occurs, the Store will inform the Customer.
A Pre-order Product is subject to the normal statutory withdrawal rules unless it also constitutes a Personalised Product within the meaning of applicable law.
For Products purchased through Pre-order, the statutory period for withdrawal after delivery begins when the Consumer receives the Product, not when the Pre-order was originally placed.
Personalised and Custom Products
A Product is considered personalised or custom-made where it is non-prefabricated and manufactured according to the Customer’s individual specifications or clearly personalised to satisfy their individual requirements.
This may include, for example, Products made in a special colour, size, configuration, embroidery or other specification that is not part of Bambolina’s standard offer.
Where permitted by applicable law, the statutory right of withdrawal does not apply to such Personalised or Custom Products.
The Customer will be informed before purchase where a Product is treated as personalised and is therefore excluded from the statutory right of withdrawal.
5. PRICES

Product prices are displayed in the currency applicable to the Customer or selected in the Store.

The Customer will see the price applicable to their order before placing the order.
-
Where required by applicable law, prices displayed to Consumers include applicable VAT or other applicable consumption taxes.
-
The total price of the order, including applicable taxes and delivery charges payable to the Store, is displayed before the Customer places the order.
-
Shipping costs are not included in the Product price unless expressly stated otherwise.
-
The Store may change prices, introduce new Products, discontinue Products or collections and organise or end promotional campaigns.
-
Price changes do not affect orders that have already been successfully placed.
-
Where the Store announces a price reduction, the legally required information regarding the lowest price applied during the relevant period before the reduction will be displayed where applicable.
6. PLACING AN ORDER

To place an order, the Customer selects the Product and its available variant, adds it to the cart and proceeds through Shopify Checkout.
-
Before completing the order, the Customer has the opportunity to review and correct the order details.
-
The Customer selects an available delivery method and payment method.
-
Before placing the order, the Customer is informed of the total amount payable.
-
By using the checkout button indicating an obligation to pay, the Customer places an order involving an obligation to pay the stated amount.
-
After an order has been placed, an electronic confirmation is sent to the e-mail address provided by the Customer.
-
A sales contract is concluded when the Store confirms acceptance of the order, unless the checkout process clearly provides otherwise.

If the Store cannot fulfil an order, it will inform the Customer and refund any amount already paid for the unavailable Product.
7.
ORDER CHANGES AND CANCELLATIONS
The Customer may contact the Store at:
to request a change or cancellation of an order.
In-stock Products
Requests to change or cancel an In-stock Product should be submitted as soon as possible. Bambolina will endeavour to accommodate the request provided that the order has not already been dispatched.
This does not affect the Consumer’s statutory right of withdrawal.
Made-to-order and Pre-order Products
For Made-to-order and Pre-order Products, Customers are requested to submit any changes to the selected size, colour, model or other order details within 3 days of placing the order.
After this period, Bambolina may already have purchased materials, allocated materials to the order or started production. For this reason, requested changes may no longer be possible.
A request to cancel a Made-to-order or Pre-order Product may also be submitted at any time before dispatch. Where the Customer is a Consumer, this provision does not limit the statutory right to withdraw from a distance contract in accordance with applicable consumer law.
Personalised and Custom Products
For Personalised or Custom Products made according to the Customer’s individual specifications, Customers may request changes or cancellation within 3 days of placing the order, provided that materials have not yet been purchased specifically for the order and production has not begun.
After materials have been specifically purchased for the personalised order or production has commenced, cancellation or modification may no longer be possible.
Where a Product is non-prefabricated and manufactured according to the Customer’s individual specifications or clearly personalised, the statutory right of withdrawal may be excluded in accordance with applicable consumer law.
Nothing in this section limits any mandatory statutory rights available to Consumers.
8. PAYMENT METHODS
Payments are processed through the payment methods currently enabled in the Store and displayed to the Customer during Shopify Checkout.
Depending on the Customer’s country, currency and availability, payment methods may include:

Not every payment method is available to every Customer.
The payment methods actually available for a particular transaction are those displayed to the Customer during checkout.
Payments may be processed by Shopify Payments or another payment service provider made available through the Store.
The Store does not store full payment card details itself where payment information is processed by the relevant authorised payment provider.
An order requiring advance payment may be processed after successful payment authorisation or confirmation.
If payment is unsuccessful or not completed, the order may remain unpaid or be automatically cancelled.
9. DELIVERY

Bambolina ships Products to destinations made available through the Store.

Available shipping methods, prices and estimated delivery times are displayed during checkout.

Bambolina may use, depending on destination and availability:

InPost,

FedEx,
-
postal operators,
-
other courier or delivery services available through the Store.
-
Standard international postal delivery normally takes approximately 5–30 days, depending on destination, local postal services and customs procedures.
-
Faster courier services may be available for selected destinations.
-
Delivery times are estimates unless a specific delivery deadline has expressly been agreed.
-
Preparation time and delivery time are separate.
For example, a Made-to-order Product may require up to 30 working days for production before the delivery period begins.

Where one order contains Products with different preparation periods, the Store may dispatch the complete order once all Products are ready unless otherwise agreed.

Tracking information will be provided where available.
-
The Customer is responsible for providing a complete and correct delivery address.
-
If an order is returned because the Customer provided an incorrect address, failed to collect the parcel or otherwise prevented delivery for reasons attributable to the Customer, the Store may require payment of reasonable and documented costs of resending the parcel, to the extent permitted by law.
10. RISK OF DAMAGE DURING DELIVERY
Where a Product is delivered to a Consumer by a carrier selected by the Store, the risk of accidental loss or damage generally passes to the Consumer when the Consumer or a third party designated by them, other than the carrier, takes physical possession of the Product.
If a parcel appears visibly damaged when delivered, the Customer is encouraged to photograph the parcel and report the damage to the carrier and the Store.
Failure to prepare a carrier damage report does not automatically deprive a Consumer of statutory rights against the Store.
11. INTERNATIONAL ORDERS, CUSTOMS AND IMPORT CHARGES

Orders delivered outside the European Union may be subject to customs clearance, import VAT, customs duties, brokerage fees or other charges imposed by the destination country.

Unless expressly stated otherwise during checkout, these charges are not included in the Product price or shipping fee charged by Bambolina.

Such charges, where applicable, are the responsibility of the recipient.
-
Customs regulations, thresholds and tax rules differ between countries and may change.
-
The Customer should check applicable import rules in the destination country before placing an order.
-
Bambolina is not responsible for delays caused by customs authorities or import procedures beyond its reasonable control.
12. CONSUMER RIGHT OF WITHDRAWAL
A Consumer who purchases a Product through the Store generally has the right to withdraw from the distance sales contract without giving any reason within 14 days.
For the purchase of a single Product, the withdrawal period begins on the day on which the Consumer or a third party designated by the Consumer, other than the carrier, takes physical possession of the Product.
Where Products from one order are delivered separately, the withdrawal period begins after receipt of the last Product, batch or part, where applicable under the law.
To exercise the right of withdrawal, the Consumer must inform Bambolina of the decision to withdraw through an unequivocal statement.

The Consumer may use the model withdrawal form included at the end of these Terms & Conditions, although its use is not mandatory.
It is sufficient to send the withdrawal statement before the 14-day period expires.
13. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The statutory right of withdrawal does not apply in circumstances provided for by applicable law.
In particular, it may not apply to a Product that is:

non-prefabricated,
-
manufactured according to the Consumer’s individual specifications, or
-
clearly personalised to satisfy the Consumer’s individual needs.
Therefore:
In-stock Products – returnable: subject to the statutory right of withdrawal.
Standard Made-to-order Products – returnable: where the Customer selects only standard variants offered by Bambolina.
Standard Pre-order Products – returnable: subject to the normal statutory withdrawal rules.
Personalised / individually customised Products – non-returnable: where the statutory exception for individually specified or personalised goods applies.
Bambolina will clearly identify personalised Products or customisation options where the statutory withdrawal exception applies.
14. RETURN OF PRODUCTS
After notifying Bambolina of withdrawal, the Consumer must send the Product back without undue delay and no later than 14 days from the date on which the withdrawal was communicated.

Before returning a Product, the Customer is encouraged to contact:
to help identify the order and return.
The Consumer bears the direct cost of returning a Product following a standard withdrawal from the contract unless Bambolina has expressly agreed otherwise.
The Customer should package the Product appropriately to protect it during transport.
Cash-on-delivery return parcels are not accepted.
15. CONDITION OF RETURNED PRODUCTS
The Consumer may handle and inspect a Product only to the extent necessary to establish its nature, characteristics and functioning, in a manner comparable to inspecting the Product in a physical store.
The Consumer may be responsible for any reduction in the Product’s value resulting from handling beyond what is necessary for such inspection.
Products should therefore, where reasonably possible, be returned:

clean,
-
unworn other than necessary fitting,
-
free from odours,
-
with original labels and accessories,
-
appropriately protected for transport.
The absence of original packaging, a label or a fiscal receipt does not automatically deprive the Consumer of statutory rights.
16. REFUNDS FOLLOWING WITHDRAWAL
In the event of a valid withdrawal, Bambolina will refund payments received from the Consumer for the returned Product.
Where required by applicable law, the refund will also include the cost of the original delivery up to the amount corresponding to the least expensive ordinary delivery method offered by the Store for the order.
If the Consumer chose a delivery method more expensive than the least expensive ordinary delivery option, Bambolina is not required to refund the additional difference.
The refund will be made without undue delay and no later than 14 days after Bambolina is informed of the Consumer’s decision to withdraw.
Bambolina may withhold the refund until the returned Product has been received or until the Consumer provides evidence that the Product has been returned, whichever occurs first.
The refund will generally be made using the same payment method used for the original transaction unless otherwise expressly agreed.
17. COMPLAINTS – LACK OF CONFORMITY OF GOODS
Bambolina is responsible to Consumers for the conformity of Products with the sales contract in accordance with applicable consumer law.
A Product should correspond to the description, type, quantity, quality, functionality, durability and other characteristics required by the contract and applicable law.
Where a Product is not in conformity with the contract, the Consumer may submit a complaint to Bambolina.
The Consumer may request:

repair, or
-
replacement.
Where the statutory conditions are met, the Consumer may also request:
-
an appropriate reduction in price, or
-
withdrawal from the contract.
Where the lack of conformity is significant, the Consumer may be entitled to request a price reduction or withdraw from the contract without first requesting repair or replacement where permitted by applicable law.
Bambolina is generally responsible for a lack of conformity existing at the time of delivery and disclosed within two years from delivery of the Product, unless applicable law provides greater protection.
18. COMPLAINT PROCEDURE

To allow efficient processing of the complaint, the Customer is encouraged to provide:

name and surname,
-
order number or another means of identifying the purchase,
-
description of the problem,
-
date the problem was discovered,
-
photographs where useful,
-
the remedy requested.
A fiscal receipt is not required where the purchase can be demonstrated by another means.
Bambolina will respond to a Consumer complaint within 14 days of receiving it, as required by applicable law.
Where Bambolina fails to respond within the statutory period, the legal consequences provided by applicable law apply.
Where repair, replacement or examination of the Product requires the Product to be made available to Bambolina, Bambolina will provide appropriate instructions.
The Consumer does not bear the costs that the seller is legally required to bear in connection with bringing a non-conforming Product into conformity with the contract.
19. HANDMADE PRODUCTS
Bambolina products are handmade.
Small variations in:
-
knitting tension,
-
texture,
-
arrangement of fibres,
-
dimensions,
-
handmade finishing,
-
placement or shape of handmade details
may occur naturally between individual pieces.
These variations form part of the handmade character of the Product and make each piece unique.
They do not constitute a defect or lack of conformity where the Product remains consistent with its description, agreed characteristics, intended use and reasonable quality expectations.
This provision does not limit the Consumer’s mandatory statutory rights.
20. PRODUCT CARE
The Customer should follow the care instructions provided:

with the Product,
-
on the Product page,

or in other care information supplied by Bambolina.
Damage caused exclusively by improper washing, drying, storage, maintenance, mechanical damage or use contrary to the Product’s intended purpose may not constitute a lack of conformity for which Bambolina is legally responsible.
This provision does not limit mandatory Consumer rights.
21. PRODUCT SAFETY – GPSR
Bambolina takes appropriate measures to ensure that Products offered in the Store comply with applicable product safety requirements, including Regulation (EU) 2023/988 on general product safety, where applicable.

Product-specific safety information, warnings, age recommendations or instructions are provided on the Product page, label, packaging or accompanying documentation where required.
Customers should follow all Product-specific warnings and instructions.
If a Customer becomes aware of a potential safety issue involving a Bambolina Product, they should stop using the Product where appropriate and contact:
When contacting Bambolina about a safety issue, Customers are encouraged to provide the order number, Product identification and photographs where available.
22. INTELLECTUAL PROPERTY
Unless otherwise stated, the contents of bambolina.pl, including:

photographs,

graphics,

illustrations,

logos,
-
trademarks,

Product descriptions,

texts,
-
designs,
-
layouts,
-
other creative materials
are owned by Bambolina or used by Bambolina with appropriate permission.
These materials are protected under applicable intellectual property law.
Unauthorised copying, reproduction, distribution, modification or commercial use is prohibited except where permitted by applicable law.
23. CUSTOMER ACCOUNTS
Where customer accounts are available, creating an account is voluntary unless otherwise stated.
The Customer is responsible for protecting account credentials against unauthorised access.
The Customer should inform Bambolina if unauthorised access to the account is suspected.
A Customer may request deletion of the account.
Deletion of an account does not require Bambolina to delete information that must or may lawfully be retained for accounting, tax, legal, fraud-prevention or other legitimate purposes.
24. PRIVACY POLICY
The processing of personal data is governed by Bambolina’s separate Privacy Policy.
The Privacy Policy explains, among other things:

who is the controller of personal data,
-
what personal data are processed,
-
purposes and legal bases for processing,
-
recipients and service providers,
-
international data transfers where applicable,
-
retention periods,
-
the Customer’s rights under GDPR,
-
contact information concerning privacy matters.
The Privacy Policy forms a separate document and should be read independently from these Terms & Conditions.
25. COOKIE POLICY
The use of cookies and similar technologies on bambolina.pl is governed by Bambolina’s separate Cookie Policy and the cookie consent mechanism available on the Store.
Cookies or similar technologies requiring consent are used in accordance with the choices made by the website visitor through the available consent mechanism.
The Cookie Policy explains the categories and purposes of cookies and other relevant information.
The Cookie Policy is separate from both these Terms & Conditions and the Privacy Policy.
26. OUT-OF-COURT CONSUMER DISPUTE RESOLUTION
A Consumer may use available out-of-court consumer complaint and dispute resolution procedures where applicable.
In Poland, Consumers may seek assistance from, among others:

municipal or district consumer ombudsmen,
-
consumer organisations,
-
the competent Provincial Inspectorate of Trade Inspection,
-
other competent consumer dispute resolution entities.
Information regarding available consumer dispute resolution procedures is available through the Polish Office of Competition and Consumer Protection (UOKiK).
Use of out-of-court dispute resolution does not deprive a Consumer of the right to bring a claim before a competent court.
27. FORCE MAJEURE AND EVENTS OUTSIDE THE STORE’S CONTROL
To the extent permitted by law, Bambolina is not responsible for delays caused by circumstances beyond its reasonable control, including, for example:

natural disasters,

serious transport disruption,
-
war or armed conflict,
-
strikes,
-
customs restrictions,
-
government actions,
-
major telecommunications failures,
-
payment infrastructure failures,
-
other extraordinary external events.
Where such circumstances materially affect an order, Bambolina will endeavour to inform the Customer.
This section does not limit mandatory Consumer rights.
28. CHANGES TO THE TERMS & CONDITIONS
Bambolina may update these Terms & Conditions where reasonably necessary, including because of:

changes in applicable law,
-
changes in Store functionality,
-
changes in payment methods,
-
changes in delivery methods,
-
changes in Bambolina’s business operations.
Changes to the Terms & Conditions do not adversely affect sales contracts already concluded before the amended version becomes effective.
The current version is published on bambolina.pl.
29. GOVERNING LAW
These Terms & Conditions and contracts concluded through the Store are governed by Polish law.
Where the Customer is a Consumer habitually residing in another country, this choice of Polish law does not deprive the Consumer of protection afforded by mandatory provisions of the law applicable to them where such protection cannot legally be excluded by agreement.
Nothing in these Terms & Conditions limits mandatory rights granted to Consumers under applicable Polish or European Union law.
30. FINAL PROVISIONS

Matters not expressly regulated by these Terms & Conditions are governed by applicable provisions of Polish and European Union law.

If any provision of these Terms & Conditions is invalid or unenforceable, this does not affect the validity of the remaining provisions to the extent permitted by law.

The Terms & Conditions are made available electronically free of charge in a form enabling Customers to access, save and reproduce them.

Before placing an order, the Customer has the opportunity to read and accept these Terms & Conditions.
-
The version of the Terms & Conditions applicable to a particular order is the version made available to the Customer when the order is placed.
